Texas Rule of Civil Procedure 78a goes into effect today! |
Texas Rule of Civil Procedure 78a goes into effect today, September 1, 2010. A civil case information sheet is now required for all new civil lawsuits and applications filed in the State of Texas (not just Harris County). Specifically, Rule 78a requires that the civil case information sheet must accompany the filing of an original petition and a post-judgment motion for modification or enforcement in a case arising under the Family Code. Further, the civil case information sheet must be signed by the attorney for the party filing the pleading or by the party.

Also, e-filers should be aware that if the petition or application is e-filed, the case information sheet must not be the lead document -- it should be uploaded as an attachment to the petition.
